The standard legal test is: Does a reasonable person have an "expectation of privacy" in a given situation. I think it is safe to say one has such an expectation when in an uber car.

Uber's response - that drivers should follow "local regulations" - is frustrating corporate blather, as you would expect. But, in their defense, it is very hard to state anything definitively in this area.

I know from years of researching the adjacent space: the legality of recording calls. In both cases, everyone falls back on "reasonable expectation of privacy" which is a very fluid concept, of course.
